Ariat Referral Program Terms & Conditions

As a Referral member (a “Referrer”), you are subject to Ariat’s Terms of Use and Ariat’s Privacy Policy, both available on ariat.com, as well as the following additional Terms & Conditions for Ariat’s Referral Program:

• Eligibility. Eligibility is limited to individuals located in the United States only. Subject to such exceptions as may be determined by us, participants (Referrers and Referred Customers, as defined herein) must be at least 18 years old. Employees of Ariat or their subsidiaries, affiliates, or promotional agencies, including immediate family and household members and those participating in the ExpertVoice program, are not eligible to participate in the Ariat Referral Program. In addition, all persons referring new customers (each, a “Referrer”) must be legally permitted to provide the personal information (e.g., name, email address and phone number) of each Referred Customer (as that term is defined below). Ariat’s Referral Program cannot be used by businesses for affiliate lead generation as determined in Ariat’s sole discretion.
• Qualified Referral. A Qualified Referral is defined as a purchase made at ariat.com by a person (a "Referred Customer") who 1) arrives to the Ariat website by clicking the Referral program link sent by Friendbuy at the Referrer’s request and 2) is a first-time purchaser of Ariat products. The Referrer is limited to one Qualified Referral for each Referred Customer; in other words, additional/repeat purchases made by a Referred Customer are not counted as additional Qualified Referrals.
• Referred Customer. The Referred Customer and the Referrer cannot be the same person for example, by using a different email address. Referred Customers will receive an email with a promotional code (the “Discount Code”) that can be used at checkout on orders of a certain overall value, in accordance with these Terms & Conditions, To use the Discount Code, the Referred Customer must be logged into an account on ariat.com, and then use the Discount Code on a qualifying purchase within thirty (30) days of receipt of the Discount Code. The Referred Customer will receive a reminder email if he/she does not use the Discount Code within three (3) days of receipt. If the Referred Customer does not already have an account on ariat.com, the Referred Customer must create one, at which point, the Referred Customer may, but is not obligated to, opt-in to Ariat marketing emails. Ariat may offer different reward options and denominations from time to time, and the specific terms for each promotion will be set forth in the relevant promotional copy.
• Referrer Codes. For you to earn a referral promotional code as a Referrer (“Referrer Code”), the Referred Customer must complete an order on Ariat’s website. The Referrer Code is awarded after Ariat has verified that a Referred Customer has completed a purchase on ariat.com. There will be a reasonable delay between completion of the Referred Customer’s purchase and when a Referrer Code is emailed to the Referrer.
• Reward Limitations. Discount Codes and Referrer Codes (together, “Rewards”) (i) have no cash value; (ii) may not be combined with other offers, discounts, or promotions; (iii) may not be sold, transferred, bartered, assigned or pledged to any third party; and/or (iii) may not be applied toward previous purchases or the purchase of gift cards. You have no property rights or other legal interests in any Rewards. You are responsible for paying applicable taxes, if any, on the value of the Reward(s). Rewards expire thirty (30) days after issuance unless stated otherwise.
• No Spam. You must comply with all up-to-date “SPAM” laws. For example, emails must be created and distributed in a personal manner and bulk email distribution is strongly discouraged. Any distribution of your referral link that could constitute unsolicited commercial email or "spam" under any applicable law or regulation is expressly prohibited and will be grounds for immediate termination of your account and exclusion from the Ariat Referral Program. You will indemnify and hold Ariat, its directors, officers, employees, shareholders, agents and successors harmless, from and against any claims that may arise from any unlawful forwarding or sharing of the referral link.
• Right to Close Accounts. Ariat reserves the right to close the account(s) of any Referrer and/or Referred Customer and to request proper payment if the Referrer and/or Referred Customer attempts to use the Ariat Referral Program in a questionable manner (in Ariat’s sole discretion) or breaches any of these Terms & Conditions or is in violation of any law, statute or governmental regulation.
• Right to Cancel Program or Change Terms. Ariat reserves the right to cancel the Ariat Referral Program or to change these Terms & Conditions at any time in its sole discretion. Any unclaimed Rewards will be forfeited at that time.
• Miscellaneous. Additional terms, conditions, exclusions, and restrictions may apply to the Rewards or your use of the Rewards. Ariat reserves the right to limit the Ariat Referral Program to certain Ariat products.
