ARIAT INSIDER PROGRAM TERMS AND CONDITIONS

The Ariat Insider Program (“Program”) is offered exclusively by Ariat Europe Ltd. (“Ariat”). Members participating in the Program agree to be bound by these Program Terms and Conditions and Ariat’s Privacy Policy which is incorporated by reference. The Privacy Policy describes how we collect, use and share information. In the event that there is any conflict among these Program Terms and Conditions and the Privacy Policy, these Terms and Conditions will govern.

THE ARIAT INSIDER PROGRAM TERMS AND CONDITIONS (“PROGRAM TERMS AND CONDITIONS”) INCLUDE A CLASS ACTION WAIVER AND REQUIRE BINDING ARBITRATION ON AN INDIVIDUAL BASIS TO RESOLVE DISPUTES. DETAILS ARE SET FORTH BELOW. BY PARTICIPATING IN THE PROGRAM YOU AGREE TO ACCEPT THESE PROGRAM TERMS AND CONDITIONS AND ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTAND, AND CONSENT TO THE PRIVACY POLICY, WHICH IS INCORPORATED INTO, AND MADE A PART OF THIS CONTRACT.

ARIAT RESERVES THE RIGHT TO UPDATE OR MODIFY THESE PROGRAM TERMS AND CONDITIONS AT ANY TIME WITHOUT PRIOR NOTICE. THOSE CHANGES WILL GO INTO EFFECT ON THE LAST UPDATED DATE SHOWN IN THE REVISED PROGRAM TERMS AND CONDITIONS. CONTINUED PARTICIPATION IN THE PROGRAM FOLLOWING SUCH CHANGES CONSTITUTES YOUR ACCEPTANCE OF CHANGES. FOR THIS REASON, WE ENCOURAGE YOU TO REVIEW THE PROGRAM TERMS AND CONDITIONS WHENEVER YOU VISIT OUR WEBSITE.

These Program Terms and Conditions supersede all previous terms and conditions applicable to the Program. All Program benefits, offers, rewards, and services are subject to availability.

Changes to the Program

Ariat may at any time amend, modify, supplement, or terminate the Program, these Program Terms and Conditions, the structure for earning Rewards, or the ability to obtain certain Rewards. If the Program is terminated, all unredeemed Rewards will be forfeited without any obligation or liability and will not be honored upon termination.

General Program Membership and Eligibility

The Program is a free rewards program open to UK and EU residents (excluding the EU territories we do not ship to) who are at least 16 years of age, who provide and maintain a working email address and have an online account at ariat.com. Membership in the Program (“Membership”) is free and optional. No purchase is required to sign up. Eligible minors must obtain a parent’s or legal guardian’s consent.

Membership in the Program includes a variety of benefits made available by Ariat in its sole discretion (“Rewards”). The timing and availability of any Reward is determined by Ariat in its sole discretion. Rewards have no cash value and are non-transferable. 

Your Membership is non-transferable and is subject to present and future Program rules. Your membership is valid only at ariat.com. Ariat may modify eligibility for Membership, Rewards, or any other feature of the Program at any time, and without prior notice, in its sole discretion, except as otherwise set forth in these Program Terms and Conditions or as required by applicable law.

Enrolling in the Program

You may enroll in the Program at Insider by signing up for an ariat.com account, providing a working email address and completing a customer profile. Upon enrollment, you will have online access to your account and will be able to manage your profile. Alternatively, if you are an existing subscriber to Ariat’s email list, you will automatically be enrolled in the Program. You may opt-out at any time by clicking the “opt-out” link in emails you receive from Ariat. By signing up for this Program, you agree to receive coupons and marketing material including emails from Ariat and our third-party marketing partners. You may unsubscribe at any time by selecting “Email Preferences” after logging in to your account at ariat.com.

Membership Termination

Your Membership will remain active until terminated, either by Ariat or by you. Ariat reserves the right to terminate your Membership at any time, for any reason or no reason, and at its sole discretion. Any abuse or manipulation of the Program or its Rewards, as determined by Ariat in its sole discretion, failure to abide by these Program Terms and Conditions, misrepresentation in your enrollment information or customer profile, may result in the termination of your Membership and/or the deactivation of your account at ariat.com. 

You may cancel your Membership at any time by contacting us by phone at +44 1367 242818 or emailing us at customer.care@ariat.com. Cancellation may take 2 to 4 weeks. Upon cancellation, your Membership will be deactivated, all offers associated with your Membership account will expire immediately, and your account at ariat.com will be deactivated.

Free Shipping

Membership includes free standard shipping within UK and Europe on qualifying online purchases over £100/100€/1000kr. To receive free shipping, you must be logged into your Ariat Insider account when checking out. No adjustments will be made to prior purchases.

Free Returns

Membership includes free online returns within UK and Europe on qualifying online purchases. To receive free returns, the item must have been purchased using your email address enrolled in the Program and associated with your active account at ariat.com. No adjustments will be made to prior returns. 

Early Access

Membership includes early access to certain promotions and launches on ariat.com. Announcements for certain sales and new products will be sent via email or SMS.

Birthday Gift

Membership includes a 10% off birthday offer each year. In order to receive your birthday offer you must be enrolled in the Program before the month of your birthday. Birthday offers will be sent via email on the 1st of the month of your birthday to the email address enrolled in the Program. Birthday offer can be used online at checkout, during the month of your birthday, with your email coupon. Coupons cannot be combined with other offers, promotions or be applied towards previous purchases, and have no cash value. There will be a limit of one coupon per person per year.

Anniversary Appreciation

Membership includes recognition of your annual anniversary in the program. Anniversary recognition is subject to change and may differ from year to year. You will receive an email at the email address enrolled in the Program with further details describing the anniversary recognition during the month of your Membership anniversary. Appreciation gifts have no cash value and cannot be combined with other offers, promotions or be applied towards previous purchases. There will be a limit of one appreciation gift per person per year.

Communications about the Program, including changes to these Program Terms and Conditions, may be sent by Ariat to your email address enrolled in the Program, via SMS messaging, or posted at ariat.com. Limitation of Liability

THE LAWS OF CERTAIN JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LEGAL WARRANTIES, CONDITIONS, REPRESENTATIONS, LIABILITY OR CERTAIN DAMAGES. IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE BELOW EXCLUSIONS OR LIMITATIONS MAY NOT APPLY. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, ARIAT OR ITS AFFILIATES WILL NOT BE LIABLE FOR ANY DAMAGES OF ANY KIND ARISING OUT OF OR IN CONNECTION WITH YOUR PARTICIPATION OR MEMBERSHIP IN THE PROGRAM, INCLUDING DAMAGES ARISING OUT OF CHANGES TO OR TERMINATION OF THE PROGRAM. THIS LIMITATION OF LIABILITY APPLIES TO ALL DAMAGES OF ANY KIND, INCLUDING BUT NOT LIMITED TO DIRECT, INDIRECT, INCIDENTAL, PUNITIVE OR CONSEQUENTIAL DAMAGES, LOSS OF DATA, INCOME OR PROFIT, LOSS OF OR DAMAGE TO PROPERTY AND CLAIMS OF THIRD PARTIES. TO THE EXTENT PERMITTED BY APPLICABLE LAW, THE LIMITATIONS ON ARIAT'S LIABILITY SET FORTH HEREIN SHALL APPLY WHETHER FOR BREACH OR REPUDIATION OF CONTRACT, OR WHETHER IN TORT, CIVIL LIABILITY BY WAY OF NEGLIGENCE, GROSS NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGE. BY AGREEING TO THESE TERMS, YOU WILLINGLY AGREE (OR, IF YOU ARE A MINOR, YOUR PARENT OR LEGAL GUARDIAN WILLINGLY AGREES) THAT YOU HAVE RELINQUISHED YOUR RIGHT TO SEEK THESE DAMAGES FROM ARIAT AND THAT THIS IS A REASONABLE ALLOCATION OF RISK.

Dispute Resolution

Unless otherwise stipulated in applicable mandatory laws of your country of residence, you and Ariat agree that any dispute, claim or controversy arising out of or relating to these Program Terms and Conditions or to your participation in the Program (collectively “Disputes”) will be settled by binding arbitration, except that each party retains the right to seek injunctive or other equitable relief in a court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of a party’s copyrights, trademarks, trade secrets, patents, or other intellectual property rights. You acknowledge and agree that you and Ariat each are waiving the right to a trial by jury or to participate as a plaintiff as a class member in any class action proceeding. Further, unless you and Ariat agree otherwise in writing, the arbitrator may not consolidate more than one person’s claims and may not preside over any form class action proceeding. If this specific paragraph is held unenforceable, then the entirety of this “Dispute Resolution” section will be deemed void. Except as provided in the preceding sentence, this “Dispute Resolution” section will survive any termination of the agreement contained in these Terms.

Arbitration Rules and Governing Law. Any dispute arising out of or in connection with this Agreement, including any question regarding its existence, validity or termination, shall be referred to and finally resolved by arbitration under the London Court of International Arbitration (LCIA) Rules, which Rules are deemed to be incorporated by reference into this clause. The number of arbitrators shall be three. The seat, or legal place, of arbitration shall be London, United Kingdom. The language to be used in the arbitral proceedings shall be English.

This Program and these Terms and Conditions will be governed by and construed under the substantive laws of England, and you submit to the exclusive jurisdiction of the courts of England.  However, if you are a resident in a country other than England, these Terms and Conditions may be subject to mandatory consumer protection laws and regulations in force in your country of residence which may provide you with additional rights.

Miscellaneous

You acknowledge and agree that all Rewards are delivered to you under this Program without payment of any fee or other consideration whatsoever. All Rewards are promotional in nature and are not paid for by you, they are subject to an expiration date and/or forfeiture under certain circumstances, including when merchandise is returned. You do not own any right, title, or interest in any Reward. The Program is void where prohibited by federal, state, or local law.
