California Privacy Rights

If you are a California resident, you have certain rights with respect to your personal information. Those rights and how you may exercise them are described below.

This notice supplements Ariat’s General Privacy Policy.

Shine the Light

California Civil Code Section 1798.83 permits Ariat customers who are California residents to request certain information regarding and/or opt-out of our disclosure of personal information to third parties for their direct marketing purposes. Please note, that as a user of the service, you cannot opt-out of some administrative communications that are reasonably necessary to the service, such as billing or service notifications.

California Privacy Rights Act (CPRA)/ California Consumer Privacy Act (CCPA)

California law provides you with the right to request: (a) access to the personal information collected in the previous 12 months; (b) deletion of personal information; (c) correct inaccurate personal information and (d) to opt out of the “sale” or “sharing” as defined under the CPRA and CCPA, of personal information.

These rights are subject to certain exemptions and exceptions as well as certain steps that must be taken to verify your identity.

Right to Know

You may request that we provide you for the last 12 months a list of the categories of personal information we have collected about you, the categories of sources from which it was collected, the business purpose for collecting or “selling” the information, and the categories of “third parties” to whom we disclosed or “sold” that information. You may also request that we provide you a copy of the specific pieces of personal information we have collected about you in the past 12 months. You may make a request to know up to two times in a 12-month period, subject to limitations described in the law. Right to Correct or Delete

You may request that we correct any inaccurate personal information that we have collected from you. You may also request that we delete any personal information that we have collected from you. However, the law exempts certain information from deletion. For example, we may keep information necessary for security and fraud detection. We also may keep information needed to provide you goods or services. When we respond to your request to delete, we will explain what (if any) information we have kept and why. Please note that the law does not consider anonymized or pseudonymized information to be “personal information,” and we may “delete” your information by anonymizing or pseudonymizing it.

Right to Limit Use and Disclosure of Sensitive Personal Information

From time to time, we may receive inquiries from consumers who may provide us with sensitive personal information concerning a consumer’s health. Such information may be shared with reputable third-party vendors to help us address the specific inquiry.

You can limit the use and disclosure of this sensitive personal information to the extent we are able to provide you goods and services. When we respond to your request to limit use or disclosure, we will explain (if any) information we have kept and why.

Right to Non-Discrimination

Ariat does not discriminate against customers who exercise their rights under applicable privacy law. We will not deny you goods or services, charge you different rates, or give you different discounts because you used one of these rights.

This is to protect your information.

Authorized Representative

You may also designate an authorized representative to make data subject rights requests on your behalf. We will require verification that you did in fact authorize the representative.

Right to Opt Out of “Sale” or “Sharing” of Personal Information

We also deploy cookies on our Website that collects data from our customers, which may also be considered a “sale” of data under CA law. You can opt out of this program by clicking on the “Do Not Sell or Share My Info” link at the bottom of our Website.

Notice of Financial Incentive

We offer our customers a loyalty program (the “Ariat Insider Program”) that provides certain perks, such as rewards and exclusive offers. We may also provide other programs, such as sweepstakes, contests, or other similar promotional campaigns (collectively, the “Programs”). When you sign up for one of these Programs, we typically ask you to provide your name and contact information (such as email address and/or telephone number). Because our Programs involve the collection of personal information, they might be interpreted as a “financial incentive” program under California law. The value of your personal information to us is related to the value of the free or discounted products or services, or other benefits that you obtain or that are provided as part of the applicable Program, less the expense related to offering those products, services, and benefits to Program participants.

You may withdraw from participating in a Program at any time by contacting us using the designated method set forth in the applicable Program Terms and Conditions.

Minors

We do not knowingly collect personal information from children under 16. If you are a parent or guardian and you are aware that any of your children have provided us with personal information without your consent, please contact us and we will take steps to remove that information.

Do Not Track Disclosure

“Do Not Track” is a privacy preference that users can set in their web browsers. Please note that many web browsers support Do Not Track technology. If you enable “Do Not Track,” the browser may send a message to websites requesting them not to track the user. If you do so, we will not use information about your web viewing activities to tailor your online experience on our Website.
